TERMS OF SERVICE AGREEMENT

Introduction

 

Welcome to EcoHikes, where we connect you to the most breathtaking natural landscapes across the Eastern Ghats, Western Ghats, and the Himalayas. By booking or participating in our treks and trips, you acknowledge and agree to abide by the following terms and conditions. This document outlines the rules, risks, liabilities, and responsibilities for both EcoHikes and participants. Please read carefully before proceeding with your booking.

 

1. Participation Eligibility

 

    •    Participants must be at least 18 years old to join any EcoHikes event independently. Minors may participate only if accompanied by a parent or legal guardian who accepts full responsibility for the minor.

    •    Physical fitness is a critical requirement for all treks and trips. Participants are required to disclose any pre-existing medical conditions, allergies, or disabilities at the time of booking. EcoHikes reserves the right to deny participation if a participant is deemed unfit for the activity.

 

2. Assumption of Risks

 

    •    By signing up, participants voluntarily assume all risks associated with trekking and adventure activities, including but not limited to:

    •    Accidents due to challenging terrains, altitude sickness, or adverse weather conditions.

    •    Wildlife encounters or other natural hazards.

    •    Transportation-related delays or breakdowns.

    •    EcoHikes takes all reasonable precautions to ensure safety but cannot guarantee a risk-free experience. Participants are expected to exercise caution and adhere to all instructions provided by guides.

 

3. Booking and Payments

 

    •    A non-refundable deposit is required to confirm your booking. The remaining balance must be paid before the trek/trip start date.

    •    Bookings are only confirmed after receipt of full payment. Failure to make payments within the stipulated timeline may result in cancellation without refund.

    •    EcoHikes reserves the right to modify itineraries or cancel events due to unforeseen circumstances, including weather, political unrest, or insufficient group size.

 

4. Participant Responsibilities

 

    •    Participants must follow the instructions and guidelines provided by the trek leader or guide. Failure to do so may result in immediate termination of participation without refund.

    •    Participants are responsible for carrying appropriate gear, clothing, and essentials as listed in the pre-trek communication.

    •    Littering, defacing property, or causing harm to wildlife is strictly prohibited. Non-compliance may result in penalties or removal from the group.

5. EcoHikes’ Rights

    •    EcoHikes reserves the right to make final decisions regarding itinerary changes, accommodation arrangements, and participant inclusion during the trek.

    •    EcoHikes holds the authority to deny participation to individuals displaying inappropriate behaviour, such as intoxication, aggression, or endangering others.

 

6. Limitation of Liability

 

    •    EcoHikes is not liable for:

    •    Injuries, illnesses, or deaths occurring during the trek or trip.

    •    Loss, theft, or damage to personal belongings.

    •    Delays, cancellations, or additional expenses due to unforeseen events such as natural disasters, strikes, or government regulations.

    •    Participants are strongly advised to procure travel insurance covering trekking activities.

 

7. Unforeseen Circumstances

    •    In case of unforeseen events like natural calamities or political unrest, EcoHikes reserves the right to cancel or reschedule treks. Participants will be offered alternative dates or partial refunds at the organisation’s discretion.

 

8. Consent for Media Usage

    •    By participating in EcoHikes events, you consent to being photographed or filmed. EcoHikes may use this media for promotional purposes unless otherwise specified in writing before the event.

9. Legal Jurisdiction

    •    All disputes arising under these Terms and Conditions shall be subject to the jurisdiction of courts in Visakhapatnam.

10. Alcohol, Drugs, and Prohibited Activities

    •    The use of alcohol, drugs, or any intoxicating substances during EcoHikes events is strictly prohibited.

    •    Participants engaging in disruptive, unlawful, or unsafe behaviour that jeopardizes the experience or safety of others will be immediately removed from the event at their own cost.

    •    Such individuals will be solely responsible for any legal consequences resulting from their actions.

    •    Additionally, participants involved in these activities may be held liable for any penalties or extra costs incurred by EcoHikes, including but not limited to logistical expenses for their removal or damages caused to property or the event.

    •    EcoHikes reserves the right to take further legal action if deemed necessary.
